1. Who provides the service, and what these terms cover
StackUp Web (app.stackupgym.com) is provided by Alexander Papenfuß (address and contact in the Impressum). These terms cover using StackUp Web in a browser. The StackUp app for Android is free and stays free; these terms apply to it only where they concern the account the app and the web share.
2. What StackUp Web is
StackUp Web shows the training log the StackUp app syncs on a big screen and reads it for you. It needs the app and a Google account you signed in with in the app. StackUp Web gives no medical advice (see section 10).
3. Your account
You sign in with your Google account. You can sign out, sign out everywhere and delete your account at any time, in the app and in StackUp Web; that is always free. Deleting removes the account and the copy of your log on the server at once; the log on your devices stays.
4. What is free and what is paid
The app, its training log and sync are free. The readings in StackUp Web are part of a paid subscription once they are on sale. Until then StackUp Web may be open to single accounts, or to everyone as a free beta. Prices are final prices in euro, VAT included. A discount during the beta or from a code applies as stated at the purchase.
5. Purchase, term and cancellation
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle's buyer terms apply as well.
A subscription runs monthly or yearly and renews for the same period unless it is cancelled before. You can cancel at any time, effective at the end of the period you paid for, without signing in on StackUp Web's cancellation page or in Paddle's customer portal. When the paid period ends, StackUp Web closes; the app and sync are not affected. If you delete your account during a running subscription, the subscription is cancelled at the end of the paid period.
6. Right of withdrawal
As a consumer you have a right of withdrawal. The details are in the withdrawal information.
7. Availability and changes
StackUp Web is run with care, but uninterrupted availability is not guaranteed, for example during maintenance or outages. Readings may be added or change; a feature you paid for is not removed without replacement during the paid period.
8. Your data
Your training log is yours. You can export it from the app at any time. How your data is processed is in the privacy policy.
9. Liability
Liability is unlimited for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. For slight negligence, liability exists only for breach of essential contractual obligations and is limited to the damage typically foreseeable for this kind of contract.
10. Health
StackUp suggests weights and reps by fixed rules that you set yourself. That is not medical or exercise-science advice. Train only as your body allows, and see a doctor about any health question.
11. Changes to these terms
If these terms change, you are told by email or in StackUp Web before the change takes effect. For a running subscription the new terms apply only from the next renewal, and you can cancel before it.
12. Law and jurisdiction
German law applies. Mandatory consumer protection rules of the country you live in remain unaffected.
